2. Toepasselijkheid
Deze algemene voorwaarden zijn van toepassing op ieder aanbod van PEPTIVE en iedere overeenkomst die via onze webshop tussen PEPTIVE en een klant tot stand komt.
Voordat een bestelling wordt afgerond, krijgt de klant de mogelijkheid deze voorwaarden te raadplegen.
Wanneer een bepaling uit deze voorwaarden geheel of gedeeltelijk ongeldig of niet-afdwingbaar blijkt te zijn, blijven de overige bepalingen van kracht.
3. Ons aanbod
Wij streven ernaar onze producten, prijzen en overige informatie zo nauwkeurig mogelijk weer te geven.
Een aanbod bevat voldoende informatie zodat voor de klant duidelijk is wat hij of zij bestelt en welke prijs daarvoor geldt.
Kennelijke fouten, vergissingen en verschrijvingen, bijvoorbeeld een evident onjuiste prijs, zijn niet bindend.

4. Totstandkoming van de overeenkomst
Een overeenkomst komt tot stand wanneer de klant een bestelling via onze webshop plaatst en PEPTIVE deze bestelling accepteert.
Na het plaatsen van de bestelling ontvangt de klant doorgaans elektronisch een orderbevestiging.
PEPTIVE behoudt zich het recht voor een bestelling te weigeren of te annuleren wanneer daarvoor een gerechtvaardigde reden bestaat, bijvoorbeeld bij:
- een kennelijke fout in prijs of productinformatie;
- vermoeden van fraude of misbruik;
- betalingsproblemen;
- onvoldoende voorraad;
- beperkingen op verzending of verkoop;
- een bestelling die mogelijk in strijd is met toepasselijke wet- of regelgeving.
Wanneer een reeds betaalde bestelling door PEPTIVE wordt geannuleerd, wordt het daarvoor betaalde bedrag terugbetaald voor zover de klant geen producten heeft ontvangen waarop betaling verschuldigd blijft.
5. Onderzoeksproducten en bestemming
Producten die PEPTIVE als onderzoeksproducten aanbiedt, zijn uitsluitend bestemd voor laboratoriumonderzoek, analytische toepassingen en andere rechtmatige onderzoeksdoeleinden.
Tenzij bij het betreffende product uitdrukkelijk anders wordt vermeld, zijn deze producten niet bedoeld voor:
- menselijke consumptie;
- dierlijke consumptie;
- therapeutische toepassing;
- diagnostische toepassing;
- zelfmedicatie;
- gebruik als geneesmiddel;
- gebruik als voedingsmiddel of voedingssupplement.
Door een onderzoeksproduct te bestellen, erkent de klant dat het product uitsluitend wordt aangeschaft voor het doel waarvoor PEPTIVE het aanbiedt.
6. Verantwoordelijkheid van de klant
De klant is verantwoordelijk voor het zorgvuldig en verantwoord omgaan met gekochte onderzoeksproducten.
Dit omvat onder andere:
- correcte opslag;
- veilige hantering;
- het gebruik van geschikte apparatuur;
- naleving van relevante veiligheidsvoorschriften;
- gebruik binnen een geschikte onderzoeksomgeving;
- naleving van toepasselijke wet- en regelgeving.
De klant dient over voldoende kennis en faciliteiten te beschikken om op verantwoorde wijze met het betreffende onderzoeksproduct om te gaan.
PEPTIVE is niet verantwoordelijk voor gebruik van producten in strijd met de aangegeven bestemming.
7. Wet- en regelgeving
De wettelijke status van bepaalde onderzoeksproducten kan per land of regio verschillen.
De klant is zelf verantwoordelijk voor het controleren of aankoop, bezit, invoer en het beoogde gebruik van een product op zijn of haar locatie wettelijk is toegestaan.
Dat een product op onze website beschikbaar is, betekent niet automatisch dat het in ieder land of rechtsgebied mag worden gekocht, ingevoerd, bezeten of gebruikt.
PEPTIVE kan een bestelling weigeren wanneer verzending of levering naar een bepaalde bestemming naar ons oordeel niet op verantwoorde of rechtmatige wijze kan plaatsvinden.
8. Prijzen
Alle op onze website weergegeven prijzen zijn inclusief btw wanneer dit op grond van de toepasselijke regelgeving vereist is, tenzij anders vermeld.
Eventuele verzendkosten en andere aanvullende kosten worden vóór het afronden van de bestelling weergegeven.
PEPTIVE kan prijzen op ieder moment aanpassen. Een prijswijziging heeft geen invloed op een reeds tot stand gekomen overeenkomst, behoudens kennelijke fouten of situaties waarin de wet anders bepaalt.
9. Betaling
De beschikbare betaalmethoden worden tijdens het afrekenen weergegeven.
De klant is verantwoordelijk voor het verstrekken van juiste gegevens tijdens de betaling.
Een bestelling kan worden verwerkt nadat de betaling succesvol is ontvangen of geautoriseerd, afhankelijk van de gekozen betaalmethode.
Wanneer een betaling wordt geweigerd of teruggedraaid, kan PEPTIVE de uitvoering van de bestelling opschorten of annuleren.
10. Levering
Wij streven ernaar bestellingen binnen de op onze website aangegeven termijn te verwerken en verzenden.
Vermelde levertijden zijn in beginsel indicatief, tenzij uitdrukkelijk een bindende leveringstermijn is overeengekomen.
Vertraging bij een vervoerder of andere omstandigheden buiten onze redelijke controle kunnen invloed hebben op de daadwerkelijke bezorgdatum.
De klant is verantwoordelijk voor het verstrekken van een volledig en correct afleveradres.
Wanneer een bestelling door onjuiste of onvolledige adresgegevens niet kan worden afgeleverd en opnieuw moet worden verzonden, kunnen hiervoor aanvullende verzendkosten in rekening worden gebracht voor zover wettelijk toegestaan.
11. Beschadigde of onjuiste levering
Controleer uw bestelling zo spoedig mogelijk na ontvangst.
Heeft u een verkeerd product ontvangen of is een product tijdens het transport beschadigd geraakt? Neem dan zo snel mogelijk contact met ons op en vermeld daarbij uw ordernummer.
Wij kunnen vragen om foto's van:
- het ontvangen product;
- de verpakking;
- het verzendlabel;
- eventuele zichtbare beschadigingen.
Wanneer PEPTIVE verantwoordelijk is voor een verkeerde of beschadigde levering, zoeken wij naar een passende oplossing overeenkomstig de toepasselijke wetgeving.
12. Herroepingsrecht voor consumenten
Wanneer u als consument op afstand een overeenkomst sluit, heeft u in beginsel het wettelijke recht om de overeenkomst binnen 14 dagen zonder opgave van redenen te herroepen, tenzij een wettelijke uitzondering van toepassing is.
De herroepingstermijn begint in beginsel op de dag nadat u, of een door u aangewezen derde die niet de vervoerder is, het product heeft ontvangen.

13. Uitzonderingen op retourneren

PEPTIVE past een uitzondering op het wettelijke herroepingsrecht alleen toe wanneer aan de daarvoor geldende wettelijke voorwaarden is voldaan.
Het enkele feit dat een product een onderzoeksproduct is, betekent niet automatisch dat het wettelijke herroepingsrecht vervalt.
14. Retourvoorwaarden
Wanneer een product rechtsgeldig wordt geretourneerd, dient de klant zorgvuldig met het product en de verpakking om te gaan.
Tijdens de bedenktijd mag een consument het product slechts hanteren en beoordelen voor zover dit noodzakelijk is om de aard, kenmerken en werking ervan vast te stellen.
Wanneer een consument verder gaat dan daarvoor noodzakelijk is en daardoor waardevermindering ontstaat, kan de consument daarvoor aansprakelijk zijn voor zover de wet dit toestaat.
De rechtstreekse kosten van het terugzenden zijn voor rekening van de consument, tenzij PEPTIVE aangeeft deze kosten te dragen of de wet anders bepaalt.
15. Terugbetalingen
Wanneer een consument rechtsgeldig gebruikmaakt van het herroepingsrecht, betalen wij de daarvoor verschuldigde bedragen terug overeenkomstig de wettelijke regels.
Wij mogen wachten met terugbetaling totdat wij de geretourneerde producten hebben ontvangen of totdat de consument aantoont dat de producten zijn teruggezonden, afhankelijk van welk moment eerder valt, voor zover de wet dit toestaat.
Terugbetaling vindt in beginsel plaats via dezelfde betaalmethode die voor de oorspronkelijke transactie is gebruikt, tenzij anders overeengekomen.

PEPTIVE garandeert niet dat resultaten uit externe wetenschappelijke onderzoeken onder andere omstandigheden kunnen worden gereproduceerd.
De bestemming van een onderzoeksproduct wordt bepaald door de wijze waarop het product door PEPTIVE wordt aangeboden en niet door eventuele externe informatie over de betreffende stof.
18. Aansprakelijkheid
PEPTIVE is verantwoordelijk voor de correcte uitvoering van overeenkomsten voor zover dit uit de toepasselijke wetgeving voortvloeit.
Voor zover wettelijk toegestaan is PEPTIVE niet aansprakelijk voor schade die ontstaat door:
- gebruik van producten voor een ander doel dan waarvoor zij zijn aangeboden;
- onjuiste opslag of hantering;
- het niet naleven van veiligheidsvoorschriften;
- gebruik in strijd met toepasselijke wet- en regelgeving;
- informatie of diensten van derden;
- omstandigheden die redelijkerwijs buiten onze invloed liggen.
Niets in deze voorwaarden is bedoeld om aansprakelijkheid uit te sluiten of te beperken wanneer een dergelijke uitsluiting of beperking volgens dwingend recht niet is toegestaan.
19. Overmacht
PEPTIVE is niet aansprakelijk voor vertraging of tekortkomingen die het gevolg zijn van omstandigheden waarop wij redelijkerwijs geen invloed kunnen uitoefenen, voor zover dit volgens de wet als overmacht kwalificeert.
Hieronder kunnen afhankelijk van de omstandigheden bijvoorbeeld vallen: storingen bij vervoerders of betalingsdiensten, stroom- of internetstoringen, natuurrampen, overheidsmaatregelen, oorlog, stakingen of ernstige verstoringen van logistieke ketens.
Wij zullen waar redelijk mogelijk proberen de gevolgen voor lopende bestellingen te beperken.
20. Intellectueel eigendom
De inhoud van onze website, waaronder door PEPTIVE gemaakte teksten, afbeeldingen, handelsnamen, logo's, ontwerpen en productinformatie, is beschermd door toepasselijke intellectuele-eigendomsrechten.
Zonder voorafgaande toestemming van PEPTIVE mag deze inhoud niet worden gekopieerd, verspreid, aangepast of commercieel gebruikt, behalve wanneer de wet dit uitdrukkelijk toestaat.

Bij het verwerken van persoonsgegevens handelen wij overeenkomstig ons Privacybeleid.

PEPTIVE kan deze algemene voorwaarden wijzigen wanneer dit noodzakelijk is, bijvoorbeeld vanwege veranderingen in onze dienstverlening of wet- en regelgeving.
Op een bestelling is in beginsel de versie van de algemene voorwaarden van toepassing die gold op het moment waarop de overeenkomst tot stand kwam.

24. Toepasselijk recht en geschillen
Op overeenkomsten met PEPTIVE is, voor zover wettelijk toegestaan, Nederlands recht van toepassing.
Een rechtskeuze voor Nederlands recht doet geen afbreuk aan dwingende consumentenbescherming waarop een consument op grond van toepasselijke wetgeving recht heeft.
Geschillen worden voorgelegd aan de volgens de wet bevoegde rechter.
